Sales contract
By sales contract we mean the contract which has as its object the purchase of goods and products at a distance by a consumer customer and the supplier FORBIKES Srl with headquarters in Via Agnoletti 4/F/G, 42124 Reggio Emilia (RE), that the contract is perfected using exclusively the Internet technologies made available at the address https://www.forbikes.it/en/ , by fax (0522/238020), e-mail (commerciale@forbikes.it) or through a local agent.
The company Forbikes srl informs the user who holds the status of consumer pursuant to art. 3, paragraph 1, letter a) of the Consumer Code that a European platform for the online resolution of consumer disputes ( cd ODR platform) has been established. The ODR platform can be consulted at the following address https://ec.europa.eu/consumers/odr/main/event=main.home.show ; through the ODR platform the consumer user will be able to consult the list of ADR bodies, find the link to the site of each of them and start an online dispute resolution procedure in which he is involved.
Note: The recent Regulation (EU) 2024/3228 has ordered the decommissioning of the ODR platform, which will be permanently deactivated from 20 March.
It follows that... In the event of disputes in relations with consumers, pursuant to art. 66-bis D.Lgs. 206/2005 (Consumer Code), territorial jurisdiction is unconditionally attributed to the Court of residence or domicile of the consumer, if located within the territory of the State.
Buyer's commitments
The Customer, by confirming the order electronically, declares that he/she has read and fully accepts the conditions of sale and payment indicated in the purchase process and in this contract; he/she also undertakes to read, print and keep the conditions of sale reported below as required by articles 3 and 4 of Legislative Decree no. 185/1999. The insertion of false and/or invented personal data in the data collection forms necessary for completing the order is expressly prohibited; it is also expressly prohibited to insert data of third parties or to make multiple registrations for a single Consumer.
The Supplier reserves the right to take legal action against such actions and any other fraudulent action against it and/or against other Consumers.
Order acceptance
The company reserves the right to approve the order (even if the system sends the order confirmation email immediately after completing it) only after checking the accuracy of all the data. In the event of non-acceptance of the order (for example due to lack of personal data or obvious errors in the display of prices in the database) Forbikes SRL guarantees timely communication to the Customer. They will be accepted and processed according to the availability of the moment. Forbikes SRL manages back-orders (unfulfilled); the items ordered but still in back-order will therefore ALWAYS be shipped as soon as they are available in stock, with the next order or individually. The customer may however make an express request to cancel the back-order via fax or e-mail or simply by indicating the wording 'cancel previous unfulfilled' when sending a subsequent order.
Users from Switzerland and the United Kingdom
Unfortunately, at the moment, for reasons strictly connected to internal company management needs also linked to compliance with the relevant tax and customs regulations, we are unable to process orders coming from the Swiss Confederation (CH) and the United Kingdom (UK) .

All prices on our website (products, shipping costs, payment costs, etc.) include VAT 22%.
Our selling prices may change at any time depending on new agreements with our suppliers, promotions or individual increases/decreases in the price of the item.

WEEE Eco-Contribution
LEGISLATIVE DECREE 07/25/2005 n.151-Art.10Il 151, in light of the new obligations imposed on Producers regarding the collection and treatment of electrical and electronic waste, provides for a financial instrument, defined precisely as the “RAEE Contribution”, to allow the latter to cover the costs relating to the management of RAEE.
The “RAEE contribution”, also called “RAEE eco-contribution”, consists of an additional cost item applied by the Producer to the products subject to the Regulation placed on the market. The “RAEE contribution” is functional exclusively to covering the costs of managing the RAEE and does not represent a source of profit for the Producers, for the Collective Systems, nor for the point of sale.
The Law allows Producers to decide whether to make it visible, i.e. separate from the price of the product (visible fee), or invisible, i.e. incorporate it into the total sales price of the product. A decision that will bind all the subjects of the commercial chain in the sales activities of the product itself. It is established by Legislative Decree 151/05, in fact, that if the WEEE contribution is made visible by the Producer, the Distributor is obliged to indicate to the final buyer the price of the product separate from the cost for the management of the WEEE. The management cost must be identical to that identified by the Producer, remaining unchanged during the commercial steps of the entire chain.
The “RAEE Contribution” is expected to be paid upon purchase of a new product, by the Consumer to the Distributor. The Distributor pays it to the Producer, who, in turn, passes it on to the Consortium to which it belongs and which guarantees in its name the fulfillment of the legal obligations provided for.
Forbikes applies the DL by inserting the cost of the contribution within the price of the product and during the invoicing phase the total due always separate from the cost of the item.
These General Conditions of Sale are applicable to all sales of Products concluded remotely through the Site with users who qualify as consumers. They regulate remote sales in accordance with and in compliance with the national and European regulations in force on the matter, including D.lgs. no. 70/2003, D.lgs. no. 206/2005 and subsequent amendments (hereinafter, the “Consumer Code”) and European Directive no. 2011/83 EU on Consumer rights.
